PLEASE READ THE FOLLOWING CAREFULLY. If you have any questions, have them answered before signing this document. You may wish to review this document with an attorney as this document does contain legal terms and the signing of this waver may have significant legal consequences. 

 

I, the parent or legal guardian who is identified below, desire to have my child participate in the Bittersweet Swimming &Tennis Association (BSTA)Bittersweet Barracudas Swim Team Program, and that I am fully aware that participation in any swimming activity including a swim team carries with it the possibility and risk of relatively minor injuries to very serious injury and may even include the risk of death.

 Likeness Release & Waiver: I hereby acknowledge and grant to  BSTA, the right and permission to use child(ren)’s name, voice, portrait, likeness, testimonials, and statements (including but not limited to photographs, video, film and/or other recordings), in any media and formats whether now know or later developed, for the purpose relating to developing and promoting the growth of swimming locally and at BSTA and advertising and publicizing BSTA and its’ products and/or services. I agree that any recordings, images, photographs, film and/or videotape taken of child(ren) are owned by BSTA. If I should receive any copy thereof, I shall not authorize its use by anyone else. I hereby waive all my rights to inspect and approve the finished product and materials, their use or such visual, written or audio copy as may be used in connection therewith.

 

Liability Release & Waiver: Acceptance of Swimmer’s entry in BSTA Bittersweet Barracudas Swim Team and on BSTA premises is without assumption or responsibility of any kind by BSTA, its’ coaches, employees, independent contractors, or Board of Directors. In consideration of child(ren)'s acceptance of participation in swim team at BSTA, I do hereby for and on behalf of myself, and my heirs and my legal representatives release and forever discharge BSTA, its coaches, employees, independent contractors, Board of Directors, and their representatives and their assignees, of and from any and all claims and damages, losses or injuries which may be suffered or sustained by me or child(ren) in connection with activities during the period for which such permission is granted and all claims are hereby waived and released, and I covenant not to sue therefor. Any claims or controversies arising out of this Release & Waiver shall be resolved through Mediation in Weld County Colorado.  

 

Medical Release: In full recognition and appreciation of the dangers and risks inherent in such activities, and in consideration of having my child participate in this swim team program. I, on behalf of myself and my child(ren), do hereby waive, release, and forever discharge BSTA, its members, officers, agents and employees, from and against any and all claims, demands, action or causes of action for costs, expenses or damages to personal property, personal injury, or death, which could result from participation in these activities. I understand and admit that my child(ren)'s participation in the BSTA Swim Team Program is voluntary. I understand that this waiver also includes and covers any injury, which could result during the transportation of my child(ren) to and/or from the various locations where the swim team may practice or compete. I hereby consent to the rendering of emergency first aid and other medical procedures which at the time of injury or illness as seems reasonably advisable. I further understand that I will be responsible for payment of any such medical procedures. In consideration of the acceptance of Swimmer’s participation in BSTA Swim Team, I hereby agree to abide by all applicable rules and regulation and codes of BSTA and/or the same as may be adopted by BSTA.

I affirm that my child is in good health. I further declare that my child is physically fit and capable to participate in such activities. I also understand that this document is intended by me to act as a waiver for me, as well as my heirs, executors, administrators, and assignees. I acknowledge that I have read and understand this entire document and had sufficient time to review it with the third party of my choosing.

 

       I have read and have understood this Release & Waiver. I understand by signing this Release, I have given up substantial rights and have voluntarily signed this Release & Waiver. I am at least 18 years of age and I am competent to contract in my own name. I have read this Release & Waiver before signing below, and I fully understand the contents, meaning, and impact of this Release & Waiver.
